I think if the full truth was known, everyone would still have the same opinion about everything and it would still come down to a philosophical debate on whether the punishment was too harsh. The significant facts are still facts.

So today's court ruling was basically the Court ruling against the NCAA on unconstitutionality argument, but then deciding thanks to the NCAA's reply and new matter, that the NCAA broadened the scope enough that PSU is demanded as an indispensable party to join the case. So the platiff's motion for judgment is denied, and new service of the current pleadings to PSU is required, and PSU required to file a response within 20 days of the notification deadline. But, jurisdiction once gained is not lost even if circumstances change.

And from the other day, funny how Freeh now claim Spanier's suit defames Freeh.

Can't wait for April 24th, as it is rumored Moulton's report will come out that day...

So to recap: 
1. The emails that are the "smoking gun" evidence may not have been about child abuse reporting;
2.  The "smoking gun" email may be of questionable authenticity;  
3.  The incident was not a tightly held secret within Penn State and many people outside PSU knew or learned about it; 
4.  McQueary was not told to keep quiet; 
5.  Discussions about the incident were written on University e-mail; 
6.  The "smoking gun" e-mail was not only not destroyed or deleted, but it was preserved by Schultz through a network transition; and,
7.  The incident was reported outside of PSU to Second Mile;
8.  Two PSU employees recalled the incident was reported to local child welfare authorities.  
That doesn’t sound like PSU was trying to hide anything from anyone.

I have a hard time believing that "source" isn't tilted towards their on agenda.

Sort of reinforces what I always thought about this. Local authorities choosing not to act on this. Whether that was of their own discretion or in conjunction with University officials is something we'll never know.

I heard on the radio yesterday there is a kickstarter up to fund a $300,000 statue of Paterno in downtown State College.

The town of State College is crowdsourcing a statue to honor the late Joe Paterno, and it’s wonderful that the planned site is not far from Old Main, the home of the Penn State administration that removed the original Paterno statue from outside of Beaver Stadium in July 2012. What are the university administrators thinking? Do they understand they never should have made the removal of the statue permanent? Do they understand how much they rushed to judgment to vilify Paterno? When will they do their part to restore Paterno’s place of honor in Penn State history? The locals are doing their part.

Weren't the initial allegations reported to the proper authorities and an investigation was launched that yielded nothing? Or am I not remembering history correctly?

Paterno did great things, but he also was a part of something that continued to happen over and over.

i think there were some allegations prior to the mcqueary incident that were taken to the authorities by a parent of a victim. that might be what you're thinking of

I just re-read the Freeh report timeline. The mother was the one that reported it and an investigation was launched that didn't yield enough evidence and the DA dropped the charges.

that was the 1998 incident, right? paterno, curly and schultz were informed about those charges. then, 4 years later, the mcqueary thing happens and they do nothing.

they can do as many investigations as they want, but no one's going to be able to change the narrative.

And there was no investigation with regards to the McQueary incident correct?

And Paterno did testify that McQueary came to him with allegations, but the contention is what exactly McQuery told Paterno. Am I understanding this correctly?

Paterno was never told of child rape. He was told at best that there was some improper conduct of a sexual nature per Paterno's recollection 10 years later. If you read the grand jury report, Paterno seems to struggle to actually describe what McQuery told him. McQuery testified that he wasn't clear with what he told Paterno and later emailed the prosecution stating that he couldn't be sure he saw rape, and could only say what he saw was sexual misconduct. McQuery also reported what he saw to his father and a family friend, Dr. John Dravanov. Both hold positions that per law require them to report sexual abuse but neither did. Dr. Dravanov's testimony contradicts McQuery as does Curley and Schultz. So the only person other than McQuery's father that somewhat supports McQuery's testimony is Paterno. Someone who came forward as the alleged victim is on the record stating that nothing sexual happened that night! If you actually read the testimony and actually think for yourself you'll actually realize that McQuery's story is bogus, and the chances he actually reported that what he saw as sexual is slim.
