I guess since to be fair, no one was leading at 10-hr mark and no rule is established, im not one to flip a coin. I'll extend 15 mins until someone wins by 2. (thats how we do in BBall...) so 10-8 will string someone up. 9-7 will too. simple math here...

not really esp this early and when he knows he is on the block he should be defending himself till the end even if it gives up a regular villager the gardener is more importnat

I also want to note, that I am not comfortable with this vote. I just don't want it decided on a tie and I'm not voting for someone who "may" be the gardener.
